1. General Provisions

These Terms of Service ("Terms") govern your use of the DNA Report Bot service ("Service") operated by Echidna LLC, TIN 460522441, located at 1600 148th Avenue Southeast, Bellevue, WA 98007, United States ("Company", "we", "us", "our").

By accessing or using the Service, including our Telegram bot (@mygenesbot) and website (dna.gives), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of the Service

The Service provides personalized DNA analysis reports based on raw genetic data files uploaded by users. The Service accepts data from 23andMe, AncestryDNA, and Genotek testing services. Reports are generated as PDF documents and delivered through the Telegram messaging platform.

The Service is available in English and Russian languages.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

You may only upload your own genetic data or data for which you have obtained explicit consent from the data subject.

4. User Obligations

When using the Service, you agree to:

  • Provide accurate information and authentic raw DNA data files
  • Not upload data belonging to another person without their explicit written consent
  • Not attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
  • Not use the Service for any unlawful purpose or in violation of any applicable laws
  • Not reproduce, distribute, or resell the generated reports without our prior written consent

5. Payments and Pricing

The Service offers paid DNA analysis reports. Current pricing is as follows:

  • Russian payments: 2,000 RUB per report
  • International payments: 22 EUR per report

Payments are processed through secure third-party payment providers. A report is generated and delivered only after successful payment confirmation. The Company reserves the right to change pricing at any time, with updated prices taking effect for new orders only.

6. Report Delivery

Reports are typically generated and delivered within 5–10 minutes after DNA file upload and payment confirmation. Delivery times may vary depending on file size, server load, and other technical factors. The Company does not guarantee specific delivery times.

7. Refund Policy

Due to the digital nature of the Service and the immediate delivery of reports, refunds are generally not available once a report has been generated and delivered. Refunds may be considered in the following cases:

  • Technical failure preventing report generation through no fault of the user
  • Payment was charged but no report was delivered due to a system error
  • Duplicate payment for the same DNA data file

To request a refund, contact us at support@dna.gives within 14 days of payment.

8. Intellectual Property

All content, software, algorithms, designs, and other materials associated with the Service are the intellectual property of Echidna LLC and are protected by applicable copyright and intellectual property laws. The generated reports are provided for your personal use only.

9. Medical Disclaimer

The Service is intended for informational and educational purposes only. The reports generated by the Service do not constitute medical advice, diagnosis, or treatment. You should not make health decisions based solely on the information provided in the reports. Always consult a qualified healthcare professional before making any changes to your health regimen.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to damages for loss of profits, data, or health outcomes.

The Company's total aggregate liability for any claims arising from the Service shall not exceed the amount paid by you for the specific report giving rise to the claim.

11. Data Processing

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, process, and protect your genetic data and personal information.

12. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to the Service, other users, or third parties.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.
